Article 1

Name and Headquarters

  1. The University of Cape Verde hereinafter referred to as Uni-CV, is a public higher education establishment.
  2. Uni-CV has its headquarters in the city of Praia and may create delegations and other forms of representation, organization, and operation in any part of the national territory or abroad.

Article 2

Nature

  1. Uni-CV is a legal person governed by public law and enjoys cultural, scientific, pedagogical, administrative, financial, patrimonial, and disciplinary autonomy.
  2. Uni-CV also has the regulatory power, under the terms of the law, to develop provisions of these Statutes and to approve the respective internal regulations.
  3. For the pursuit of its purposes, Uni-CV may enter into agreements, protocols, contracts, and other agreements with public or private institutions, national, foreign, or international.
  4. Uni-CV may freely create or promote the creation of legal persons governed by private law, be part of, or incorporate within its scope, subsidiary entities governed by private law, such as foundations, associations, and societies, designed to assist it in the strict performance of its purposes.

Article 3

Mission and purposes

  1. The University of Cape Verde is a public institution of higher education that, through its teaching, research, and extension activities, fosters the creation and dissemination of culture, science, and technology, in order to promote the qualification of the Cape Verdean nation. , as a strategic factor in the country's human and sustainable development.
  1. Uni-CV pursues, among others, the following purposes:
  2. To promote human development in its entirety, with an emphasis on scientific, technical, ethical, social, cultural, and artistic dimensions, and having as a paradigm the incessant search for high-quality standards;
  3. Foster fundamental and applied research activities aimed at contributing, in a creative way, to the country's development;
  4. Promote the dissemination of cultural, scientific, and technical knowledge that constitute the national heritage;
  5. Contribute to critical reflection and the construction of a fairer and more democratic society;
  6. Promote the entrepreneurial capacity of Cape Verdean society, contributing to the training of human resources in priority areas for development;
  7. Provide diversified services to the community, in a perspective of mutual appreciation;
  8. Develop scientific, technical, and cultural exchange with national and foreign research and higher education institutions;
  9. Contribute to the development of international cooperation and to bringing peoples closer, namely in the fields of education and knowledge, science and technology; and
  10. Contribute to the modernization of Cape Verde's educational system at all levels, namely through research, adoption, and dissemination of new teaching methodologies and knowledge promotion, taking advantage of Information and Knowledge Technologies (ICT).

Article 4

Values

Uni-CV respects and promotes, in its action, the essential values ​​that derive from the principles and rights enshrined in the Constitution of the Republic and the Basic Law of the Educational System, namely:

Academic freedom - Uni-CV must assume and be understood as a privileged space for the creation of knowledge and promotion of culture, free expression of thought and circulation of ideas, respect for ethics and valuing people, not being subjected to political and ideological constraints of any kind;
  1. Excellence – Uni-CV is committed to the relentless pursuit of knowledge, standing at the forefront of scientific and technological innovation and quality assurance;
  1. Autonomy - Uni-CV is an autonomous institution, insofar as it is granted the necessary powers and means that allow it, under the terms of the law and these Statutes:
  2. Set your goals and targets;
  3. Develop the respective plans and programs and ensure their implementation and evaluation;
  • To guarantee the free exercise of teaching, research, and university extension functions, as well as to ensure broad access to the information sources required by the process of active promotion of knowledge.
  1. Quality - Uni-CV assumes, namely, the following dimensions as constitutive of the concept of quality:
  2. Relevance, in the sense that doing university is socially relevant;
  3. Equity, in the sense of expanding educational access and success opportunities for all Cape Verdeans, regardless of their social status and place of residence; and
  • Competency-based curriculum approach, understood as the ability to mobilize, in an integrated manner, with relevance and effectiveness, a set of knowledge and other knowledge acquired to solve problems in a variety of situations or contexts of academic, personal, social, or professional life;

Entrepreneurship – Uni-CV systematically promotes, within the scope of academic activities, the mobilization, and application of science, with a view to technological innovation, the promotion of creative initiative, and the development of the entrepreneurial capacity of its graduates and Cape Verdean society.

Sustainability – in the performance of its mission and in the pursuit of its goals, Uni-CV must ensure that the respective activities and initiatives have the proper managerial and financial support, in order to safeguard their effectiveness, as a guarantor of the University's further development;
  1. Solidarity – given the social responsibility inherent in its condition as a public university, Uni-CV develops social solidarity policies and practices associated with merit as one of the foundations of sustainability;
  1. Internationality – Uni-CV is oriented towards its insertion in regional and global spaces of higher education and science that are guided by high standards of academic quality and excellence.

Article 5

Cultural and scientific autonomy

Within the scope of its cultural and scientific autonomy, Uni-CV can freely define, program, and execute teaching, research, and extension activities, of a cultural and scientific nature, necessary for the pursuit of its purposes.

Article 6

Pedagogical autonomy

In exercising its pedagogical autonomy, without prejudice to what is established by law, Uni-CV enjoys the power to create, suspend and terminate courses, taking into account the guidelines and priorities of higher education policy defined by the Government.

Uni-CV has autonomy in the preparation of study plans and subject programs, in the definition of teaching and learning methods, in the choice of knowledge assessment processes, and in the testing of new pedagogical experiences.

In the use of pedagogical autonomy, Uni-CV and its units ensure the plurality of doctrines and methods that guarantee the freedom to teach and learn.

Article 7

Administrative, financial, and equity autonomy

  1. Uni-CV exercises administrative autonomy, issues regulations, enters into contracts, practices administrative acts, and other acts under the terms provided for in the law and in these Bylaws.
  2. Within the scope of its financial autonomy, and within the framework of the program contracts signed with the State, the University of Cape Verde:
  3. Freely manage the annual funds allocated to you in the state budget;
  4. It has the ability to transfer funds between different budget lines and chapters;
  5. It prepares the University's Strategic Plan or, alternatively, the multi-year plan of activities, which it executes in accordance with the respective budget and through annual activity plans;
  6. It has the capacity to obtain its own revenues, which it generates annually through private budgets, according to criteria established by it, and can directly lease buildings that are essential for its operation; and
  7. Exercises the other powers provided for in the law and in these Statutes.
  8. Within the scope of patrimonial autonomy, Uni-CV disposes of its assets without other limitations than those established by law.
  9. Uni-CV's assets are made up of assets, rights, and obligations of economic content, subject to private legal commerce, related to the achievement of its purposes, including those that have been assigned to it by the State, by other public or private entities or by other entities. are, in any capacity, concerned with the pursuit, directly or indirectly, of their attributions and competencies.
  10. The real estate assets of Uni-CV are also acquired or built properties, even if on land belonging to the State.

Article 8

disciplinary autonomy

Uni-CV has the power to punish, under the terms of the law and the respective regulations, teachers, students, and non-teaching staff for breaches of established disciplinary rules.

There is always a right to appeal against sanctions applied under disciplinary autonomy, under the terms of the applicable law and regulations.

Article 9 

Oversight

In carrying out its mission and pursuing its purposes, Uni-CV is subject to the superintendence of the member of the Government responsible for Higher Education, under the terms of the law.

The contract program referred to in paragraph 2 of article 7 consolidates the convergence of the Government's strategic guidelines for public higher education with the mission, purposes, and priorities of Uni-CV, identifies the means made available to it for its execution and, in its elaboration, obeys the parameters established in Decree-Law no. 20/2012, of 19 July, in the new wording given by Decree-Law no. 12/2015 of 24 February.

Article 10

Network organization

In order to fully pursue its purposes, Uni-CV adopts the network organization model, which consists of integrating and enhancing the capacity of its various organic units as well as organizations of different levels and of a varied nature to which it is associated, regardless of its geographic location, to promote educational, research and extension activities accessible to citizens from different parts of the national territory and the Cape Verdean diaspora.
