Article 17

University government and management bodies

  • The Uni-CV government bodies are:
  1. The University Council;
  2. The Dean;
  3. The Scientific Council;
  4. The Pedagogical Council;
  5. The Council for Quality and Evaluation; and
  6. The Advisory Board.
  1. The Uni-CV Administrative Council works with the Rector, which is a management body in the administrative, financial and patrimonial domains, under the terms provided for in these Statutes.
  2. There may also be other management bodies, as provided for in the Uni-CV Organic Regulations.

Subsection I

University Council 

Article 18

Nature and composition

  1. The University Council is the University's strategic decision-making and supervisory body.
  2. Members of the University Council:
  3. The Dean, who presides;
  4. The President of the Scientific Council;
  5. The President of the Pedagogical Council;
  6. Teachers' representatives, in number of 2 (two), for each organic unit, elected by the respective peers;
  7. Student representatives in a number of 2 (two) in total, elected by the respective pairs;
  8. 2 (two) non-teaching staff representatives, elected by their respective peers; and
  9. 3 (three) personalities of recognized merit in scientific, cultural, and socio-economic circles, co-opted by the other members, at the proposal of the Rector.
  1. In addition to the effective members referred to in the previous number, the Vice-Rectors, the Pro-Rectors, the General Administrator, the Presidents of the organizational units and other entities representing civil society, invited by the Rector, may also participate, without the right to vote.
  1. The method of electing the representatives of the bodies referred to in subparagraphs d) to f) of paragraph 2 is established in a specific electoral regulation.
  1. The University Council ordinarily meets once a quarter and, extraordinarily, whenever called by the Rector, on his initiative or at the request of 1/3 (one third) of its members.

Article 19

Skills

  1. It is incumbent upon the University Council:
  2. Approve Uni-CV's strategy and development proposals;
  3. Approve the measures that ensure the articulated functioning between the organic units;
  4. Approve proposals for the creation, alteration, suspension or extinction of courses from the organizational units;
  5. Approve proposals for the creation, integration, modification or extinction of organic units in the University structures;
  6. Approve the school calendar;
  7. Presenting proposals for amendments to these Statutes and submitting them to the oversight governmental entity under the terms of the law;
  8. Approve the Uni-CV regulations and ratify the regulations of the other collegiate bodies;
  9. Approve the provisional management instruments, the annual activities and accountability plan of Uni-CV, namely the annual activities report;
  10. Approve the attribution of the Doctor Honoris Causa degree to entities of recognized merit, either because of their academic path, or because of the scientific work carried out, or because of their meritorious intervention concerning Uni-CV or Cape Verde or any other reason justifying this decision is made; and
  11. Pronounce itself on any matter that, not falling within the specific competence of any other Uni-CV body, is presented to it by the Rector.
  12. In addition to the provisions of the Rector's powers, the University Council may delegate regulatory powers to the Rector with a view to the efficient and effective management of the University.

Subsection II

Dean

Article 20

Nature

The Rector is Uni-CV's highest governing, management, and external representation body.

Article 21

 Election

  1. Under the law, the Rector is elected, by secret ballot, from among university professors with doctoral degrees at Uni-CV, with at least 3 (three) years of teaching, research, and/or management experience in higher education in Cape Verde.
  2. The outgoing Rector communicates to the superintendent governmental entity, within 10 (ten) business days, the result of the election, so that he may appoint the elected Rector within a maximum period of 20 (twenty) business days.
  3. The governmental superintendence entity can only refuse the appointment of the elected Rector on the grounds of malpractice in the electoral process.
  4. The Rector-elect takes office before the University Council.
  5. The Rector's term of office is 4 (four) years, and he cannot be elected for more than 2 (two) consecutive terms.

Article 22

Election process

  1. Elections are held, on a date set by the University Council, between November 15th and January 31st.
  2. When the term ends before the period referred to in the previous number, the Rector guarantees the practice of all management acts necessary for the administration of the University.
  3. The Rector is elected by an electoral college composed of:
  4. Teachers with at least 2 (two) years of full-time service at Uni-CV, whose electoral expression must represent 60% (sixty percent) of the votes;
  5. Employees with at least 2 (two) years of full-time service at Uni-CV, with a contract valid in the academic year in which the elections are held, whose electoral expression must represent 20% (twenty percent) of the votes;
  6. Students with more than 1 (one) year of attendance and regular academic status, whose electoral expression must represent 20% (twenty percent) of the votes.
  1. The candidate who obtains the absolute majority of the validly cast votes, with the weighting provided for in the previous number, is proclaimed Rector.
  2. If no candidate has obtained the votes required in the previous number, a second vote is taken, to which the 2 (two) candidates with the most votes in the first vote are admitted.
  3. In the second voting, to be carried out within a period not exceeding 15 (fifteen) business days after the first voting is carried out, the candidate who obtains the highest number of votes, with the weighting provided for in paragraph 3, is proclaimed Rector.

 

Article 23

Rectory team

  1. The Rector is assisted in the exercise of his functions by:
  2. Vice-Rectors, in a maximum number of 2 (two), freely appointed and dismissed by themselves, from among Ph.D. professors at Uni-CV;
  3. Pro-Rectors, in a maximum number of 4 (four), freely appointed and dismissed by themselves, from among Ph.D. professors at Uni-CV, for the development of specific attributions.
  4. The Vice-Rectors and Pro-Rectors cease functions with their dismissal and, in any case, with the end of the Rector's mandate.
  5. Vice-Rectors and Pro-Rectors may be exempted, in whole or in part, from providing the teaching service by order of the Rector.

Article 24 

Competencies

  1. It is incumbent upon the Rector:
    • To preside over university acts and meetings of Organs collegiate bodies of Uni-CV, except as provided for in these Statutes and the regulations;
  1. Establish committees and preside over those whose meetings to attend;
  2. Keep the superintendence entity and the University Council informed about the life, problems, and development of Uni-CV;
  3. Directing and supervising the University and, in particular, ensuring the coordinated action of the bodies, organizational units, and services in the performance of their competencies and attributions;
  • Ensure the University's cooperation with similar and partner institutions, at national and international levels;
  1. Approve regulations in the development of normative acts approved by the University Council or that establish norms with short term validity;
  • Checking university degrees and signing the respective diplomas, in accordance with the regulations;
  1. Authorize the hiring of teaching, research, technical and administrative staff and give them ownership, under legal and regulatory terms;
  2. Admit and exclude students, under the regulatory terms;
  3. Exercising disciplinary power over university personnel, under legal and regulatory terms;
  4. Promote the preparation of provisional management instruments and accountability documents and monitor the implementation of the former;
  5. Appoint the Presidents of Faculties and Schools, following or not their election, under the terms and conditions to be defined by specific regulations;
  6. Appoint the other members of the governing councils of the Faculties and Schools as proposed by the respective presidents;
  7. Authorize expenses, without prejudice to the competence of the Administrative Council;
  8. Assume all the powers delegated to it by the governmental superintendence entity; and
  9. Anything else that results from the law, statutes, and regulations of Uni-CV.
  1. The Rector is also responsible for all powers that, by law or under the terms of these Statutes, are not assigned to other bodies of Uni-CV.
  2. The Rector may delegate to the Vice-Rectors, the Pro-Rectors, and the General Administrator the competencies that may be necessary for efficient and effective management.
  3. Whenever deemed convenient for the good management of the University, the Rector may also delegate part of his powers to the Board of Directors of the Organic Units or to other persons invested in management positions, and the delegated entities shall account for the activities carried out to the Rector under the conditions defined in the instrument of delegation.
  4. For the purposes of paragraph d) of paragraph 1, the Rector meets with the other bodies, organizational units, and services of Uni-CV whenever he considers it necessary to ensure the normal functioning of the institution.
  5. The Rector is exempt from providing the teaching service.

Article 25

 Inability

  1. When the Rector's temporary incapacity is verified, the Vice-Rector shall assume his duties.
  2. In the absence of such a designation, the Vice-Rector who has held the position for the longest time assumes functions or, on an equal footing, the Vice-Rector with more seniority in the highest category.
  3. In the absence or impediment of the Vice-Rector, the Rector is replaced by the Pro-Rector that he designates by order, applying, in the absence of such appointment, the provisions of the previous number, with the necessary adaptations.
  4. If the incapacity situation lasts for more than 90 (ninety) days, the University Council must pronounce on the replacement of the Rector and the opportunity for a new electoral process.
  5. In case of vacancy, resignation, or recognition by the University Council of the permanent incapacity of the Rector, that body shall determine its replacement by the Vice-Rector, who organizes the electoral process, under the same terms established by paragraphs 2 and following of article 22.

Article 26

Suspension or dismissal

  1. In case of persistent gravity for the life of Uni-CV, attributable to the Rector, the University Council, convened by 1/3 (one third) of its members, provided that elements of the different bodies are represented, may, by reasoned deliberation, be approved by a majority of 2/3 (two thirds) of the effective members, suspend the Rector from the exercise of his functions and, after a specific process instituted by the University Council, with the right to contradictory, determine his removal, without prejudice to the provisions in the next issue.
  2. The decision of the University Council to suspend or dismiss the Rector must be preceded by a favorable opinion from the Advisory Council, approved by a majority of 2/3 (two-thirds) of its effective members.
  3. The suspension and dismissal referred to in the previous numbers only become effective after approval by the governmental superintendence entity.
  4. The Dean may also be removed under the terms and conditions provided for by law.

Article 27

General Administrator

  1. The Rector is also assisted, in matters of a predominantly administrative, economic, financial, and patrimonial order, by the General Administrator of the University, who is responsible for:
  2. Oversee the organization and functioning of the services, under the terms of these statutes, ensuring the legality, efficiency, and effectiveness of their performance;
  3. Coordinate the preparation of Uni-CV provisional management instruments and their proper implementation;
  4. Coordinate the preparation of accountability instruments;
  5. Sign, together with the Rector, the diplomas for the award of degrees;
  6. Exercising other powers and duties that result from these Statutes, the law, and the regulations of Uni-CV or which are delegated to it by the Rector.
  7. The General Administrator is chosen by the Rector of Uni-CV, after consultation with the University Council, from among individuals with higher education, knowledge, and relevant professional experience in the fields referred to in the previous number, and shall exercise their functions under a committee of service, without prejudice to the provisions of the following paragraph.
  8. The General Administrator ceases to function at any time, upon his resignation, and, in any case, upon the end of the mandate of the Rector who appointed him.

 

Subsection III

Scientific Council

Article 28

Nature

The Scientific Council is the scientific management body of Uni-CV, respecting the strategic guidelines of the University Council and the competencies of the Rector.

 

Article 29

Composition and functioning

  1. The Scientific Council comprises:
  1. a) Full professors, by their functions, if their number does not exceed 1 (one) per organic teaching, research and extension unit, or elected by their respective peers, when in higher number, one for each of these organic units;
  1. b) Doctoral professors, elected by their respective pairs, in number from 1 (one) to 2 (two) for each organic unit of teaching, research, and extension, under the terms to be established by the University Council;
  1. c) 2 (two) personalities of recognized merit in university, scientific and technological, cultural circles, co-opted by the other members.
  1. d) 1 (one) doctoral representative of the Pedagogical Council, appointed by the latter;
  1. e) The coordinators of the specialized committees of the Scientific Council.
  1. The Scientific Council elects its president from among the members referred to in sub-paragraphs a) and b) of the previous number.
  1. The Scientific Council meets, ordinarily, 1 (once) per quarter and, extraordinarily, whenever called by the president.

 

Article 30

Competencies

  1. It is generally incumbent upon the Scientific Council of Uni-CV to promote the scientific and technological improvement of teaching and research activities, as well as to define and monitor the University's scientific quality policy, under the terms of these Statutes and applicable regulations.
  1. It is incumbent, namely, on the Scientific Council:
  1. a) Define the strategic guidelines for the University's scientific activity;
  1. b) Issue opinions on academic, scientific, and technological products;
  1. c) Approve the scientific activities plan of Uni-CV;
  1. d) Establish rules for granting degrees and titles, as well as the equivalence of national or foreign qualifications;
  1. e) Approve the rules for awarding honorary titles of the University and the entities to be awarded;
  1. f) Issue an opinion on the creation, suspension, and extinction of courses;
  1. g) Issue opinions on the creation, suspension, and extinction of teaching, research, and extension organizational units, as well as research structures;
  1. h) Formulate proposals or opinions on training and specialization plans for teaching staff;
  1. i) Issue a reasoned opinion on proposals for the recruitment of professors by invitation or for the renewal of invited professors' contracts; and
  1. j) Issuing an opinion on the rules for recruiting professors by public examination.

3.The Scientific Council is also responsible for:

  1. a) Advise the Rector in the government of the university in all matters that he intends to submit to him;
  1. b) Approve the respective regulations and submit them for ratification by the University Council;
  1. c) Approve selection boards for the appointment of associate and full professors.
  1. The competencies of the Scientific Council are exercised, at the level of Faculties and Schools, by scientific committees specialized in the matter, under the terms and conditions to be defined in the University's Organic Regulation, in the internal regulations, and deliberations of the Scientific Council.
  1. Without prejudice to the provisions of the preceding paragraph, it is incumbent upon the specialized scientific committees to assess and issue opinions on the curricular projects of the courses, the programs of the curricular units, the processes of evaluation of teaching performance, the plans and reports of academic activities of the Faculties and Schools and other matters submitted to them by the presidents of these organizational units.
  1. The specialized scientific committees referred to in the preceding paragraph may comprise one or more Faculties or Schools, depending on the affinities of these organizational units and the existing conditions, under the terms referred to in the final part of the preceding paragraph.
  1. Without prejudice to their binding to the Scientific Council, the specialized commissions exercise their attributions in articulation with the internal bodies of the Faculties and Schools.

Subsection IV 

Pedagogical Council 

Article 31

Nature

The Pedagogical Council is the pedagogical management body of Uni-CV, respecting the strategic guidelines of the University Council and the competencies of the Rector.

 

Article 32

Composition

  1. The Pedagogical Council is composed of:
  1. a) Ph.D. professors, preferably, or masters with recognized merit and pedagogical experience appropriate to the university context, elected by the professors of the organic unit in number from 1 (one) to 2 (two) by each Faculty or School, under the terms to be established by the Council of the University;
  1. b) The coordinators of the specialized committees of the Pedagogical Council;
  1. c) Student representatives in a number of 2 (two), elected by the respective pairs;
  1. d) 1 (one) representative of the Scientific Council, appointed by it;
  1. e) 1 (one) representative of the Board of Directors of each Faculty and School, appointed by the respective presidents;
  1. f) The directors of functional units of a transversal nature;
  1. g) The directors of Academic Services, Technical Services, Information Technology, and Social Action.
  1. The Pedagogical Council is chaired by a faculty member elected from among the others.

 

Article 33

Skills

  1. It is, in general, the responsibility of the Pedagogical Council of Uni-CV to promote the development and innovation of the University's pedagogical activities, the articulation of teaching, research and extension activities, curriculum integration, and the development of students' skills, under the terms of these Statutes and applicable regulations.
  1. It is especially incumbent upon the Pedagogical Council:
  1. a) Draw up the University's pedagogical activities plan, promote its execution and ensure its evaluation;
  1. b) Promote the development of pedagogical and didactic skills of teachers, following the requirements of contemporary university pedagogy;
  1. c) Issue an opinion on the regulations and curriculum plans of the courses;
  1. d) Pronouncing itself on the allocation of curricular units to teachers, curricular unit programs, evaluation of pedagogical activities, and the performance of teachers;
  1. e) Pronounce itself on the calendar of each academic year of Uni-CV;
  1. f) Monitor the execution of the pedagogical activities plan, in connection with the courses' coordination structures;
  1. g) Organizing follow-up and technical-pedagogical support for teachers and students, ensuring innovative curriculum management and maximizing academic results;
  1. h) Promote discussion forums, dissemination of studies, and dissemination of good practices in the pedagogical field and the search for solutions to pedagogical-didactic problems;
  1. i) Pronouncing and issuing suggestions on the use of common services existing at Uni-CV, to promote the quality of pedagogical activities;
  1. j) Pronouncing itself on the organization and orientation of the activities of the Academic Services, Social Action, Technical and others that contribute to the quality of training and academic success of students;
  1. k) Present and propose to the competent entities support for pedagogical, extension, and/or extra-school projects;
  1. l) Approve the respective regulations and submit them for ratification by the University Council; and
  1. m) Carry out other duties assigned to it, under the regulations or by deliberation of the University Council.
  1. The powers of the Pedagogical Council are exercised, at the level of Faculties and Schools, by pedagogical commissions specialized in the matter, under the terms and conditions to be defined in the University's Organic Regulations, in the internal regulations and decisions of the Pedagogical Council.
  1. Without prejudice to the preceding paragraph, it is incumbent upon the specialized pedagogical committees to assess and issue an opinion on the curricular projects of the courses, the programs of the curricular units, the processes of evaluation of teaching performance, the plans and reports of academic activities of the Faculties and Schools and other matters submitted to them by the presidents of these organizational units.
  1. Specialized pedagogical commissions may include one or more faculties or schools, depending on the affinities of these organizational units and the existing conditions, under the terms referred to in the final part of the previous number.
  1. Without prejudice to their link to the Pedagogical Council, the specialized commissions exercise their attributions in articulation with the internal bodies of the Faculties and Schools.

 

Subsection V

Quality and Evaluation Council

 

Article 34

Occupation

The Quality and Evaluation Council is the body responsible for establishing self-assessment mechanisms for the performance of the University, its organic units, and its scientific and pedagogical activities.

 

Article 35

Composition

  1. The Quality and Evaluation Council comprises 6 (six) or 8 (eight) personalities of recognized merit in the university, cultural, scientific, and technological circles, elected by the University Council, at the proposal of the Rector.
  1. In addition to the members referred to in the previous number, the Rector appoints the Chairman of the Quality and Evaluation Council.
  1. At its first meeting, the Quality and Evaluation Council elects, from among its members and on the proposal of the President, the Vice-President, and the Secretary.
  1. The Quality and Evaluation Council ordinarily meets 2 (two) times a year and, extraordinarily, whenever called by its chairman.
  1. The Rector meets with the Council for Quality and Evaluation whenever he considers it necessary to ensure the normal functioning of the University.
  1. The Quality and Assessment Board comprises specialized committees, namely the Ethics Committee, whose composition, functioning, and powers are set out in its regulation, without prejudice to the provisions of the following article.

Article 36

Competences

  1. It is incumbent upon the Quality and Evaluation Council to promote the quality of the University's performance in the areas of teaching and research, as well as in the provision of services, by defining performance indicators and their respective control, through methods, techniques and especially recommended procedures.
  1. For the preceding paragraph, it is incumbent, namely, on the Council for Quality and Evaluation:
  1. a) Approve, develop and make available instruments to promote quality;
  1. b) Ensure the application of quality standards in all sectors of activity of the University;
  1. c) Organizing, guiding, and coordinating the carrying out of audits and self-assessment programs of the functioning of the University and, in particular, of the courses;
  1. d) Promote a process of periodic monitoring and/or evaluation of quality control procedures;
  1. e) Define and implement mechanisms and procedures that allow the evaluation of the external effects of the courses;
  1. f) Define and implement mechanisms and procedures that allow certification of the quality of performance of the University's organic units and services, as well as academic products; and
  1. g) Approve the respective charter and submit it for ratification by the University Council.
  1. Without prejudice to the provisions of paragraph 6 of the previous article, the Ethics Committee of the Council for Quality and Evaluation is responsible for assessing and evaluating compliance with ethical and professional deontology standards within the university community, on its initiative or through complaints, participations, and complaints, making the relevant decisions and recommendations or, if applicable, referring the respective processes to the competent authority for decision, under the legal and regulatory terms.
  1. The Ethics Committee's resolutions on matters within its competence may be appealed to the Quality and Evaluation Council.
  1. In fulfilling its attributions, the Council for Quality and Evaluation liaises with the other bodies and structures of the University and relies on the specialized services of the University, and may, whenever necessary, resort to external entities of recognized prestige, for carrying out audits, evaluations and other forms of internal quality control.
  1. The Council for Quality and Evaluation articulates with the structures and entities for the evaluation of higher education instituted by the State, collaborating with them in the exercise of their competencies and attributions, under the terms of the law.

 

Subsection VI 

consulting board

Article 37

Occupation

The Advisory Board is a body designed to advise the Rector in defining strategic areas for the development of teaching and research, in the provision of services, and connection with the community.

Article 38

Composition

  1. Members of the Advisory Board of the University of Cape Verde:
  1. a) The Rector, who presides;
  1. b) The Vice-Rectors;
  1. c) The Deans;
  1. d) The General Manager;
  1. e) The Presidents of Faculties and Schools;
  1. f) Up to 10 (ten) personalities of recognized merit in the university, scientific and technological, social and cultural, economic and business, public administration, and local authorities;
  1. g) 1 (one) representative of each of the representative associations of students, faculty, and non-faculty, appointed by the competent governing body;
  1. h) Former students of Uni-CV, in number up to 2 (two); and
  1. i) Retired professors from Uni-CV, up to 2 (two).
  1. It is a preferential condition in the choice of the personalities referred to in subparagraph f) of the previous number to have high-level management experience in public and private institutions.
  1. Of the members referred to in subparagraph f) of paragraph 1, 50% (fifty percent) are chosen by the University Council and the remainder by the Rector.
  1. The members referred to in subparagraphs h) and i) of paragraph 1 shall be appointed by the University Council, as proposed by the Rector.
  1. The members referred to in subparagraph f) of paragraph 1 chosen by the Rector cannot belong to Uni-CV.
  1. The Advisory Board meets, ordinarily, 1 (once) a year and, extraordinarily, whenever called by its chairman.

Article 39 

Competences

  1. It is incumbent upon the Advisory Board to pronounce on the matters submitted to it by the Rector, namely:
  1. a) Proposals for strategic plans or multi-year activity plans, to be approved by the University Council;
  1. b) Procedures for the application of strategic guidelines within the scope of the organization of teaching-learning, research, and extension;
  1. c) The University's organic regulations and other regulations that the Rector considers pertinent to the institutional development of Uni-CV;
  1. d) Annual activity plan, operating and investment budget;
  1. e) Uni-CV annual reports and accounts;
  1. f) Creation and extinction of teaching, research, and extension organizational units; and
  1. g) Definition of the University's training offers.
  1. It is also incumbent upon the Advisory Board:
  1. a) Advise the Rector in the governance of the University, in all matters that he/she intends to submit to him;
  1. b) Approve the respective charter and submit it for ratification by the University Council.

Subsection VII

Board of Directors

 

Article 40

Occupation

The Administrative Council is the body responsible for the administrative, patrimonial, and financial management of the institution, as well as the management of human resources.

Article 41

Composition and functioning

  1. Members of the Administrative Council:
  1. a) The Rector, who presides;
  1. b) A Vice-Rector or Pro-Rector, appointed by the Rector;
  1. c) The General Manager; and
  1. d) The Presidents of Faculties and Schools.
  1. The Director of Administrative and Financial Services, who provides the secretariat for the meetings, has a seat at the meetings of the Administrative Council, without the right to vote.
  1. The Rector may delegate to the Vice-Rector or Pro-Rector referred to in subparagraph b) of paragraph 1 the presidency of the Administrative Council, without prejudice to the right to participate in the meetings of this body, whenever he so wishes.
  1. The Board of Directors meets, ordinarily, every 2 (two) months and, extraordinarily, whenever its chairman convenes it.
  1. No abstentions are allowed in voting, however, there may be explanations of vote.
  1. The minutes of each meeting must be approved and signed by all members present, but members who disagree with the content of the minutes may enter the respective declarations of vote therein.
  1. The members of the Administrative Council are jointly responsible for the acts performed in the exercise of their functions.
  1. Members who, having been present at the meeting, express their disagreement in a statement recorded in the respective minutes are exempt from liability, as well as absent members who have declared their disagreement in writing, which will also be recorded in the minutes, except in cases of force majeure duly justified.

Article 42

Powers of the Board of Directors

  1. The Administrative Council ensures the legality, efficiency, and effectiveness of the administrative, financial, and asset management of Uni-CV, without prejudice to the Rector's powers.
  1. It is incumbent upon the Board of Directors:
  1. a) Preparing the annual budget and ensuring its execution;
  1. b) Oversee the activities of revenue collection and expenses realization;
  1. c) Prepare the management account;
  1. d) Oversee the management of the university's assets;
  1. e) Accept donations, inheritances, or legacies;
  1. f) Ensure the necessary conditions for the exercise of financial and budgetary control by the legally competent entities;
  1. g) Approve the respective charter and submit it for ratification by the University Council.
  1. When it deems convenient for the good management of the University, the Administrative Council may delegate part of its powers to the Rector or other persons invested in management or leadership positions, and the delegated entities shall account for the activities carried out to the Council under the defined conditions in the instrument of delegation.

Section III

Organic Units

Article 43

general structure

  1. Without prejudice to the creation, under the terms of the law, of other organizational units that may prove necessary, the following units are included in the Uni-CV:
  1. a) Faculties: teaching, research, and extension units in the scientific and technological domains that integrate close or related areas of knowledge;
  1. b) Schools: teaching, research, and extension units in the scientific and technological domains that aggregate areas of knowledge with marked specificity;
  1. c) Research Institutes, Centers and Nucleus: structures dedicated to studies, research, and extension, following the regulations;
  1. d) Functional Units: units that, structuring themselves in the form of nuclei, groups, commissions, or other organizational forms, directly dependent on the Rector or on whom he delegates competence, aim, under the regulations, to execute specific programs and projects, permanent or temporary, of a transversal or specific nature, and which do not fully fall within the functions of the organizational units referred to in the preceding paragraphs.
  1. Without prejudice to the provisions of subparagraph c) of the previous number, the Research Nucleus have as their object the conception and execution of research activities within the scope of research projects or lines, framed in Research Institutes or Centers.
  1. The list of organizational units is included in the annex to these Statutes, of which they are an integral part.
  1. In the act of creating the organizational units, express mention must be made of their framing in one of the organizational forms referred to in paragraph 1, without prejudice to assuming, depending on the case, various names provided that they are consistent with the nature and specificity of their functions.
  1. The units referred to in subparagraphs a) and b) of no. 1 are headed by Presidents, and they also have Executive Councils, Advisory Councils, and other structures, under the regulations.
  1. The units referred to in subparagraphs c) and d) of paragraph 1 are managed by directors or coordinators, and may also have other bodies, under the regulations.
  1. By deliberation of the University Council, and under the terms to be defined in the respective regulations, the faculties may be constituted by organic units of specific scopes, with the denomination of departments.
  1. The creation and definition of regulatory norms for the organization, management, and operation of the units referred to in this article are the responsibility of the University Council.
  1. There may also be units associated with Uni-CV under the terms of the following article.

Article 44

Associated Units

  1. The associated units referred to in paragraph 9 of the previous article are public or private institutions, national or foreign, which pursue purposes at the level of teaching, research, and/or extension, cooperating with the Uni-CV according to the pertinence and adequacy of its purposes to those pursued by the university, although they are not part of the university's organic structure.
  1. Except as provided for in these Statutes, the associated units maintain institutional partnership relationships with Uni-CV under the terms of the respective association contracts, signed between the Rector and the respective top managers.
  1. The association contracts referred to in the previous number define the forms of collaboration and may include the possibility of sharing teaching and research staff and other resources, with a view to the good pursuit of common objectives.

Section IV

services

Article 45

Function and direction

  1. The Uni-CV services are specialized technical and logistical support units for the management and government bodies of the University and the organic units in the performance of their functions, namely in the preparation, execution, and evaluation of decisions, policies, standards, and instruments management of the University in the various fields of activity.
  1. Uni-CV's services are managed by directors, with an adequate profile, who depend directly, hierarchically, and functionally on the General Manager, except as provided in the following numbers.
  1. The Rector's Office is headed by a Cabinet Director who, assisted by advisers and secretaries, exercises his attributions under the hierarchical and functional dependence of the Rector, unless delegated powers.
  1. Except the Rector's Office, the services of Uni-CV are, as a whole, endowed with a Board of Directors, a collegial body of a consultative nature and support to the General Manager, chaired by him and composed of the directors of the services.

Article 46 

Structure

  1. Uni-CV's services are structured as follows:
  1. a) Dean's Office;
  1. b) Administrative and Financial Services;
  1. c) Academic Services;
  1. d) Documentation and Publishing Services;
  1. e) Social Action Services;
  1. f) Technical and Information Technology Services;
  1. g) Studies, Planning and Cooperation Office;
  1. h) Audit and Quality Control Office;
  1. i) Communication and Image Office;
  1. j) Asset Management Services; and
  1. k) Human Resources Services.
  1. Except the Rector's Office, and except as provided in the following number, the Uni-CV services may, under the regulations, have deconcentrated structures, called local services, which operate under the direction and guidance of the Faculty President or School or those to whom it delegates competence, without prejudice to its binding to the general rules and directives which govern the organization and operation of the services and other structures of the University.
  1. Under the regulations, the local services operating at the level of a university campus may be coordinated by a senior technician called the campus manager.
  1. The campus manager performs his duties under the supervision and guidance of the Presidents of Faculties and Schools, without prejudice to the competencies of the General Administrator and the Rector.

Article 47

General duties of the services

  1. The Rector's Office is a support service to the Rector, as well as to the Vice-Rectors and Pro-Rectors, in the exercise of their functions, being responsible, namely:
  1. a) Advice and logistical and organizational support for the activities of the Rectory Team;
  1. b) The management of the Rectoral Team's agendas and protocol activities;
  1. c) The organization and forwarding of the work related to the activities of the Rectory Team;
  1. d) Supporting the Rector's meetings with internal and external entities;
  1. e) The disclosure of internal rules and other guidelines issued by the Rector and/or other members of the Rector's Team, by the delegation of the Rector and/or express regulatory provision, as well as the acts and deliberations of the University's central government and management bodies.
  1. The Administrative and Financial Services ensure the current management of the University in administrative and financial matters, under the pertinent legal and regulatory terms and in harmony with the directives issued by the competent bodies of Uni-CV, namely:
  1. a) General administration functions, including activities of reception, distribution, and dispatch of documents, as well as the general archive of the University;
  1. b) Functions of planning, organizing, executing, and evaluating the administrative and financial management activities of the University.
  1. The Academic Services is responsible for the day-to-day management of the University in matters of an academic nature and, in particular, the technical and administrative support for the University's teaching projects in the field of:
  1. a) General school system for students;
  1. b) Creation, alteration, and extinction of the courses offered by the University and the respective study plans, including courses that do not lead to an academic degree;
  1. c) Evidence leading to the granting of academic degrees and titles;
  1. d) Processes for equivalence, recognition, and registration of higher-level qualifications;
  1. e) Issuance of declarations, certificates, and diplomas of studies;
  1. f) Gathering statistical information on students from the various initial and postgraduate training courses and non-degree courses;
  1. g) Processes related to mobility and exchange of students between universities; and
  1. h) Complaints presented in relation to matters within its competence.
  2. The Technical and Informatics Services is responsible for the planning, coordination, and execution of activities in the field of information and communication, multimedia and audiovisual technologies, as well as the provision of advanced technological and logistical support to academic activities, incumbent upon them, namely:
  1. a) The promotion and dissemination of Information and Communication Technologies;
  1. b) General computerization of the University;
  1. c) Support to users of information systems, the management of the institutional email system, and the issuance of directives;
  1. d) The design, implementation, and maintenance of systems and technological support platforms for the management of the University; and
  1. e) The planning, monitoring, and maintenance of university systems and equipment and infrastructure.
  1. The Documentation and Publishing Services are responsible for the day-to-day management of library, documentation, and publications, namely:
  1. a) The collection, systematization, management, and provision to all sectors of activity of the University of information or documentation of a scientific, technical and cultural nature necessary for the performance of their respective functions;
  1. b) Participation in bibliographic, scientific, and technical information systems or networks, in accordance with the interests of the University;
  1. c) The management of bibliographic and documental resources at Uni-CV; and
  1. d) The programming and/or carrying out of Uni-CV's editorial activities, namely editing, publishing, and distributing magazines, news media, scientific, literary, and cultural works.
  1. The Social Action Services is responsible for implementing the social support policy for the university community and, in particular, for its students, with a view to ensuring the right to equal opportunities of access, attendance, and school success, by overcoming economic inequalities, social and cultural, namely through the development of activities in the fields of:
  1. a) Food and accommodation;
  1. b) Health Services;
  1. c) Scholarships;
  1. d) Teaching material and other teaching resources;
  1. e) Sporting and cultural activities; and
  1. f) Other socio-educational support.
  1. The mission of the Studies, Planning and Cooperation Office is to carry out studies, collect and process information, strategic and operational planning and manage cooperation with public and private, national and foreign entities, being responsible for it, in particular:
  1. a) The collection, processing of data, and processing of statistical information of Uni-CV;
  1. b) Technical support in the preparation and execution of Uni-CV development plans, programs, and projects;
  1. c) The planning of cooperation and partnership activities with universities and other institutions, public and private, national and foreign;
  1. d) The management of Uni-CV cooperation and partnership projects; and
  1. e) Coordination of mobility projects for teachers, students, and technical staff, nationally and internationally.
  1. The Audit and Quality Control Office is the central service specialized in quality promotion and control at the University of Cape Verde, namely:
  1. a) The implementation and monitoring of compliance with the quality standards and parameters defined by the Quality and Evaluation Council;
  1. b) Technical support to the Quality and Evaluation Council in carrying out its duties; and
  1. c) Carrying out internal control activities, namely financial, pedagogical, and management audits, assessment processes, inquiries, inquiries, investigations, and disciplinary proceedings.
  1. The Communication and Image Office is the central service responsible for organizing and managing the University's internal and external communication, namely:
  1. a) Ensure the processing and dissemination of information produced by the University and about the University;
  1. b) Develop the University's communication and image strategy, in the country and abroad;
  1. c) Provide advice to the Rector, the other members of the Rectoral Team, and the heads of the organizational units in matters of communication and the University's image; and
  1. d) Ensure the regular publication of the Uni-CV bodies or media.
  2. The Asset Management Services is responsible for ensuring efficient and effective management of Uni-CV's immovable and movable assets, namely:
  1. a) To prepare, in conjunction with the other bodies, units and services, annual and multi-annual plans for the construction, acquisition, and maintenance of infrastructure and equipment, according to the needs and perspectives of institutional development of Uni-CV;
  1. b) Carry out studies and formulate proposals and projects for the construction, acquisition, or lease of infrastructure, equipment, and other assets necessary for the pursuit of the functions and policies defined by Organs competent bodies of Uni-CV;
  1. c) Carry out the necessary expedient for the construction and acquisition of buildings and other infrastructure, as well as vehicles, equipment, and other movable property, intended for the operation of Uni-CV;
  1. d) Ensure the supply of the University's bodies, units, services, and other structures with the equipment and other materials essential for its proper functioning; and
  1. e) Organize and update the computerized inventory of Uni-CV's real estate and movable assets.
  1. The Human Resources Service ensures, in conjunction with the bodies, units, and services, the planning, management, assessment, and development of human resources allocated to Uni-CV, namely:
  1. a) Provide technical assistance in the processes of recruitment, selection, integration, education, training, simulation and evaluation of human resources, as well as in any actions that contribute to promoting the institution's efficiency and effectiveness;
  1. b) Manage the human resources of Uni-CV, including teaching and non-teaching staff, from the perspective of professional development and organizational development, in compliance with the legal and regulatory provisions in force;
  1. c) Ensure and carry out the necessary expedient for the provision and change of the functional status of all Uni-CV personnel;
  1. e) Promote the workday related to absences, discipline, leaves, and vacations of staff;
  1. d) Organize and keep up to date the individual files and the general register of teachers and non-teaching workers, in accordance with the applicable rules;
  1. e) Propose rules and procedures for the management of human resources and prepare the Annual Staff Management Plan, under the applicable legal terms; and
  1. f) Provide assistance to bodies, units, and services, as well as to teachers and non-teaching workers on procedures and ways of forwarding matters relating to personnel.

Article 48 

Regulation, adequacy, and modification of the structure

  1. The organization, functioning, and development of the attributions and competencies of the services are contained in the Organic Regulation, approved by the University Council, and in specific regulations, to be approved by the Rector of Uni-CV, upon a proposal of the General Administrator and after hearing the Administrative Council.
  1. For service convenience, the structure, list, and attributions of Uni-CV's services may be modified by order of the Rector, after hearing the Council for Quality and Evaluation and the Administrative Council, with a view to their adequacy to the institutional development requirements of the university, the availability of personnel and resources and the priorities defined in certain contexts.
  1. For the convenience of service, and in view of the provisions of the previous number, the Rector, at the proposal of the General Administrator, may also merge services or assign to a director the head of more than one service.

Chapter IV - UNIVERSITY COMMUNITY

Article 49 

students

1. Uni-CV assumes the principle of the centrality of students from different cycles of studies and courses in academic management.

2. University students enjoy the rights and are subject to the duties and other provisions contained in the respective Statute.

3. The Student Statute enshrines rules on specific prerogatives and obligations for Uni-CV student workers, students in mobility arrangements, and in other special situations, without prejudice to the provisions of the law.

4. Without prejudice to the provisions of the previous number, Uni-CV students have the right to freely organize themselves in an association.

5. The University Council designates, under the proposal of the Rector, the Student Ombudsman, who is responsible, under the terms of the respective Regulation, to defend and promote the rights and legitimate interests of Uni-CV students, through an independent and impartial.

Article 50 

Teaching and non-teaching staff

1. Uni-CV personnel are subject to the general legal regime of labor relations, applicable to public institutes, being governed by the provisions contained in the Labor Code, without prejudice to the provisions of the following numbers and these Statutes.

2. The teaching staff and non-teaching staff of Uni-CV are governed by their own statutes, approved in the form of a regulatory decree, at the proposal of the Rector.

3. The statutes referred to in the previous number define the recruitment rules, the work and career regime, the rights and duties, the staff table, the salary scale, and other rules relating to the management of the respective personnel.

4. Without prejudice to the establishment in a specific diploma of the rules that define the statute of the University's teaching staff, the admission, access and professional development in the career of the teaching staff of Uni-CV obey the following rules:

a) Possession of a doctoral degree, for the purposes of entry, access, or professional development in the career;

b) Approval in a competition, which includes requirements and criteria of a scientific and pedagogical nature, for the purposes of admission and career promotion;

c) Merits proven in a public examination, based on the curricular evaluation and the performance evaluation at Uni-CV, for the purposes of career progression, without prejudice to the provisions of paragraph a).

5. Under the terms of the respective teaching staff statute, Uni-CV may recruit, under a fixed-term contract, individuals qualified with a master's or Undergraduate's degree and who demonstrate that they have the indispensable requirements for the performance of teaching functions at Uni-CV.

6. Uni-CV may also recruit, as guests or visitors, professors or national or foreign personalities of recognized merit, for the performance of teaching functions, under the terms of the statute referred to in the previous number and other applicable regulatory norms.

7. Individuals whose knowledge and skills are relevant to the development of teaching, research, and extension activities at Uni-CV may also be recruited as teachers, on a secondment, requisition, transfer, or mere service provision basis.

8. The provisions of paragraphs b) and c) of no. 4 and no. 7 apply to non-teaching staff, with the necessary adaptations.

Article 51

Oversight

Uni-CV personnel management acts that have financial implications are subject to successive inspection by the Court of Auditors.
